Can we be sure that a Republican Congress will not impeach and convict Merrick Garland and refuse to authorize any Democrat appointee?
We can't count on any Republican to block or speak out against the leadership. It is my belief that if Democrats lose control of Congress, the expedited effort to end our republic will be swift. Whether we devolve into civil war is still undetermined.
The Senate will never get the required 2/3 vote to convict.
My best guess is that soon after the mid-terms there’ll be some action from DOJ. It has all the evidence it needs. They’re writing up the indictment already!
On the basis that there is a distinct possibility Trump could cause another uprising if he is convicted of a serious national crime, it might be better to simply prevent him from ever running for office again. Let New York and Georgia continue their efforts. A conviction in the New York case might cause his bankruptcy, and a Georgia some jail time. In either case he would be a ruined man.

It IS clear that a conviction for the insurrection WOULD accomplish that under the "disqualification clause” of the 14th Amendment.
Section 3 of the Fourteenth Amendment prohibits anyone who has previously taken an oath of office (Senators, Representatives, and other public officials) from holding public office if they have "engaged in insurrection or rebellion" against the United States.
